Scope
These terms apply to www.entretienmx.fr and all subdomains of entretienmx.fr (www, api, etc.), and cover the collection, recording, use, transmission or communication of personal information as well as any use of files or databases.
2.Definitions
- User — natural person using the EMX platform, in particular the Website or the EMX Application.
- Application — mobile application available on the App Store for supported Apple devices and the Google Play Store for supported Android devices, providing access to the services offered by EMX.
- Subscription — contract entered into via the EMX platform giving access to the associated services.
- API — Application Programming Interface.
- Content — any document, alert, article or information accessible or downloadable on the Website.
- Cookie — element that does not identify the User but records information about their browsing on the Website.
3.Acceptance of the terms
The User cannot accept these Terms of Sale and Use if they are not a legally capable adult (in which case they must obtain the consent of their legal representative) or if the laws of their country of residence, or of the country from which they access the Services, prohibit such use.
The Terms of Sale and Use applicable to the User are those available on the day of their last connection to the Website, accessible in their account profile in the EMX application.
4.EMX account
If the User is not a legally capable adult, their legal representative must take part in the account creation process.
To prevent the grounds for suspension, EMX may carry out checks and request any element verifying the age and/or identity of Users. In the absence of a satisfactory response, the account may be suspended immediately and without notice.
5.Account suspension
The EMX account may be suspended immediately and without notice, in particular in the event of non-compliance with these terms or failure to respond to age and/or identity verification requests.

6.PRO account — terms of sale
Purchasing a PRO account allows the User to use the Services. The applicable offer is the one displayed in the EMX application on the day the order is registered; EMX reserves the right to modify it at any time and to run occasional promotional offers.
Payment is made via the App Store (Apple) or Google Play.
The PRO account is considered active once the first payment has been made and the account has not been suspended for the reasons set out in section 5.
7.Pre-contractual information
Before any order, the User is provided with the following information:
- the price of the Services and any additional fees;
- where the contract is not performed immediately, the date or deadline by which EMX undertakes to provide the ordered Services;
- information about EMX's identity, postal, telephone and electronic contact details, and activities, where not apparent from the context;
- information about legal and contractual warranties and how to exercise them;
- the functionality of the digital content and, where applicable, its interoperability;
- the possibility of resorting to conventional mediation in the event of a dispute;
- information about the right of withdrawal (existence, conditions, time limit, procedure and standard form), termination procedures and other important contractual terms.
